1. Acceptance of Terms

By accessing or using the Game Day DJ mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Eligibility and User Accounts

Age Requirement

  • You must be 13 years or older to create an account
  • Users under 18 require parental or guardian consent

Account Responsibilities

  • You are responsible for maintaining the security of your account credentials
  • You must provide accurate and complete information during registration
  • One account per person
  • You are responsible for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

3. User-Generated Content

Ownership

  • You retain ownership of sounds and content you upload to the App
  • By uploading content, you grant Game Day DJ a non-exclusive, worldwide, royalty-free license to store, display, and distribute your content within the App

Content Requirements

  • You must own the rights to uploaded content or have permission to use it
  • No copyrighted material without proper licensing
  • No explicit content: profanity, hate speech, sexually explicit material
  • Family-friendly content only: App is intended for sports events with all ages

Content Moderation

  • We review uploaded content before approval
  • We reserve the right to remove content that violates these Terms
  • Repeated violations may result in account suspension or termination

4. Prohibited Conduct

You agree NOT to:

  • Harass, bully, or threaten other users
  • Upload hate speech, discriminatory content, or explicit material
  • Infringe on intellectual property rights (copyright, trademarks)
  • Upload spam, malicious software, or viruses
  • Use automated tools to scrape or abuse the App
  • Impersonate others or misrepresent your identity
  • Attempt to gain unauthorized access to the App or user data
  • Use the App for illegal purposes

5. In-App Purchases and Subscriptions

Purchases

  • In-app purchases are processed through Apple App Store or Google Play Store
  • All purchases are subject to the platform's terms and refund policies
  • Prices are displayed in your local currency and may include applicable taxes

Subscriptions

  • Subscriptions renew automatically unless canceled before the renewal date
  • You can manage and cancel subscriptions in your device's app store settings
  • No refunds for partial subscription periods

Restore Purchases

  • You can restore previous purchases on new devices using the same account

6. Intellectual Property

Our Content

  • Game Day DJ name, logo, and bundled sounds are owned by or licensed to us
  • You may not copy, modify, or distribute our content without permission

Fair Use

  • Downloaded sounds are licensed for personal, non-commercial use at sports events
  • Redistribution or commercial use of our content is prohibited

7. Disclaimers and Limitations of Liability

"As Is" Service

  • The App is provided "as is" without warranties of any kind
  • We do not guarantee uninterrupted or error-free service
  • We are not responsible for third-party sounds or user-generated content

Limitation of Liability

To the maximum extent permitted by law, Game Day DJ shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of data, profits, or business opportunities
  • Damages exceeding the amount you paid for the App (if any)

Indemnification

You agree to indemnify and hold us harmless from claims arising from:

  • Your violation of these Terms
  • Your uploaded content
  • Your use of the App

8. Privacy and Data Protection

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data in compliance with GDPR and other privacy laws.

9. Termination

By You

  • You may delete your account at any time via Privacy Settings
  • Account deletion is subject to a 30-day grace period (you can restore within 30 days)
  • After 30 days, all your data is permanently deleted

By Us

  • We may suspend or terminate accounts that violate these Terms
  • We may terminate the App with 30 days' notice
  • Upon termination, your right to use the App ceases immediately

Effects of Termination

  • Downloaded sounds remain accessible offline (as permitted by license)
  • Cloud-stored data is deleted according to our retention policy
  • In-app purchases and subscriptions are non-refundable upon termination

10. Modifications to Terms

We reserve the right to modify these Terms at any time. We will:

  • Notify users of significant changes via email or in-app notification
  • Update the "Last Updated" date
  • Continued use of the App after changes constitutes acceptance

11. Governing Law and Dispute Resolution

Governing Law

  • These Terms are governed by the laws of Sweden (user's location)
  • GDPR and EU consumer protection laws apply

These Terms of Service are effective as of December 11, 2025.
